TERMS AND CONDITIONS

Horn’s Club provides a way for adults to meet each other during social events in selected European cities. This is a legal agreement ("Agreement") between you and Horns-Club.com. Please read the Agreement carefully before registering or booking to attend an event through Horns-Club.com. By registering or booking to attend an event with Horns-Club.com, you agree to the terms and conditions of this Agreement (the "Terms"). If you do not agree to the terms, please do not register or book to attend an event through Horns-Club.com. The terms are subject to change by Horns-Club.com at any time, effective upon notice to you.

Minors may not become members

By agreeing to register with Horns-Club.com or attend an event organized through Horns-Club.com, you represent and warrant that you are at least 18 years old. Either you or Horns-Club.com may prevent you from registering and attending an event through Horns-Club.com at any time, for any reason, without explanation, effective upon sending written notice to the other party. Horns-Club.com reserves the right to immediately suspend or terminate your access to Horns-Club.com, or to an off-line event organized by Horns-Club.com, without notice, upon any breach of this Agreement by you which is brought to Horns-Club.com’s attention. Upon registering for an event through Horns-Club.com it is for your sole, personal use. You may not authorize others to attend an event of your behalf. You are responsible for logging out if your computer is accessible to others. This prevents unauthorized access.

Indemnity by user

You will defend, indemnify, and hold harmless Horns-Club.com, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable solicitors' fees) relating to or arising out of your use of Horns-Club.com, including any breach by you of the terms of this Agreement.

Online content

Opinions, advice, statements, offers, or other information or content made available through Horns-Club.com, but not directly by Horns-Club.com, are those of their respective authors, and should not necessarily be relied upon. Such authors are solely responsible for such content. Horns-Club.com does not guarantee the accuracy, completeness, or usefulness of any information on the service and neither adopts nor endorses nor is responsible for the accuracy or reliability of any opinion, advice, or statement made by parties other than Horns-Club.com. Under no circumstances will Horns-Club.com be responsible for any loss or damage resulting from anyone's reliance on information or other content posted on Horns-Club.com or transmitted to Horns-Club.com users.

CODE OF CONDUCT

When using Horns-Club.com, you agree that:

You are solely responsible for the content or information you publish or display (hereinafter, "post") on Horns-Club.com, or transmit to other Horns-Club.com Members.

You will not post on Horns-Club.com, or transmit to other Horns-Club.com Members or Employees, any defamatory, inaccurate, abusive, obscene, profane, offensive, sexually oriented, threatening, harassing, racially offensive, or illegal material, or any material that infringes or violates another party's rights (including, but not limited to, intellectual property rights, and rights of privacy and publicity).

You will use Horns-Club.com in a manner consistent with any and all applicable laws and regulations.

You will not include in your profile any telephone numbers, street addresses, last names, URL's or E-mail addresses other than where asked for it in the Confidential Personal Information section.

You will not include in your profile any offensive anatomical or sexual references, or offensive sexually suggestive or connotative language, and you will not post any photos containing nudity or personal information. Horns-Club.com reserves the right, but has no obligation, to reject any profile or photo that does not comply with these prohibitions.

You will not engage in advertising to, or solicitation of, other members to buy or sell any products or services through Horns-Club.com. You will not transmit any chain letters or junk E-mail to other Horns-Club.com members.

You will not post, distribute or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior consent of the owner of such proprietary rights.

You are solely responsible for your interactions with other Horns-Club.com Users. Horns-Club.com reserves the right, but has no obligation, to monitor and/or mediate disputes between you and other Members.

Warning - please read this

It is possible other Horns-Club.com (including unauthorized users, or "hackers") may post or transmit offensive or obscene materials on the Horns-Club.com site and that you may be involuntarily exposed to such offensive and obscene materials. Horns-Club.com is not responsible for the use of any personal information that you disclose on the site. Please carefully select the type of information that you post on the Horns-Club.com site or release to others. Horns-Club.com reserves the right, but has no obligation, to monitor the materials posted in the public areas of Horns-Club.com site. Horns-Club.com shall have the right to remove any such material that in its sole opinion violates, or is alleged to violate, the law or this agreement. Notwithstanding this right of Horns-Club.com, you remain solely responsible for the content of the materials you post in the public areas of the service and in your private e-mail messages. E-mails sent between you and other Horns-Club.com users that are not readily accessible to the general public will be treated as private by Horns-Club.com to the extent required by applicable law.

Membership Charges

(a) Upgrading from MEMBER to PLATINUM membership is entirely at Horns-Club.com’s discretion and Horns-Club.com reserves the right to refuse to register any application to upgrade for any reason whatsoever.

(b) All PLATINUM Membership Fees are non-refundable. Cancellation and/or termination of membership for any reason does not entitle the Member to any refund.

(c) Horns-Club.com operates a Continuous Service Agreement for our Membership Fees. This means that Horns-Club.com automatically debits the monthly PLATINUM membership fee of 15€. To change or cancel your subscription at any time, send an email to info@horns-club.com. If you cancel your PLATINUM membership, your membership benefits will be automatically terminated.

Event Charges

(a) In addition to the Membership Fee there may also be additional charges for certain events or Services which a Member wishes to apply for. When booking an event you must pay the full amount for that event on the internet, or in person in cash. We reserve the right to charge an ‘offline’ price for manually booking members on an event if booking is arranged over the phone or email instead of the member booking themselves on the event online. This may be higher than the advertised price. These terms and conditions together with the general information provided on the Website for each individual event is the basis of your contract for each Event.

(b) You are responsible for ensuring that you are at the correct departure point / event site at the correct time (if applicable), as we cannot be liable for any loss or expense suffered by Members because of their late arrival at any departure point. It is your responsibility to ensure that you adhere to all itinerary instructions and regulations provided by Horns-Club.com and follow any instructions given to you by your driver or representative.

Refund & Cancellation Policy

Access to the majority of the Horns-Club.com web site and registration to become a Horns-Club.com Member is free. Upon booking your place at an event organised by Horns-Club.com, the relevant fee will be accepted through Paypal.

If less than 6 people have registered to attend the same event, you will be informed up to 12 hours before the event, Horns-Club.com will give you the option to transfer to another event of the same fee value, or will refund your paid fee in full within 14 days.

If you cannot attend an event that you have booked, and only if you provide Horns-Club.com with your notice of cancellation more than 72 hours (3 days) before the event is due to take place, you will be provided with a 100% refund within 14 days.

Alternatively, if you cannot attend an event that you have booked your place on, and only if, you provide Horns-Club.com with your notice of cancellation more than 3 days before the event is due to take place, subject to places being available, you will have the option to transfer onto another event to the same fee value or less, with the difference being refunded within 14 days.

If you cannot attend an event that you have booked, and less than 3 days notice of cancellation is provided, no refund will be provided but it will be at Horns-Club.com’s discretion to transfer you onto an alternative event of the same fee value or less.

If you cannot attend an event that you have booked, and less than 24 hours notice of cancellation is provided, no refund and no transfer will be provided.

For prepaid events, if less than 24 hours notice of cancellation is provided, a 3€ cancellation fee will automatically be charged to your card. For some events we negotiate a quota of participant spaces. If people fall into the habit of not showing up we lose credibility with event organisers and other members.

Termination

A Member may terminate their membership with Horns-Club.com at any time:

You can cancel your Membership or PLATINUM Membership by emailing info@horns-club.com and we will terminate your account and delete your profile within 48 hours.

Horns-Club.com may terminate or suspend the membership of any Member at any time for any reason whatsoever.

Proprietary Rights

Horns-Club.com owns and retains other proprietary rights in all services offered by Horns-Club.com. Horns-Club.com contains the copyrighted material, trademarks, and other proprietary information of Horns-Club.com, its licensors and licensees. In addition, other Members may post copyrighted information, which has copyright protection whether or not it is identified as copyrighted. Except for that information which is in the public domain or for which you have been given permission, you will not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information. By posting information or content to any public area of Horns-Club.com, you automatically grant, and you represent and warrant that you have the right to grant to Horns-Club.com and other Horns-Club.com Members an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, copy, perform, display and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sub-licenses of the foregoing. Horns-Club.com will keep confidential all information supplied by you to Horns-Club.com, including credit card number(s), and shall use or disclose such information only for the purposes for which such information was collected, or as required by law.

Complaints

To resolve a complaint regarding Horns-Club.com, you should first contact Horns-Club.com by sending an email to info@horns-club.com.

Disclaimer

Horns-Club.com is not a matchmaking service. Our aim is to provide a way to meet groups of people for Social events in selected European cities and connect online with other like minded people. Horns-Club.com does not verify personal information on its participants, such as marital status or any other aspects of their general background. It is up to you to clarify these issues to your own satisfaction.

Horns-Club.com does not have the ability to independently screen participants registering as members or to attend its organised Socials. By registering to become a member or to attend vent through Horns-Club.com, you are agreeing that neither Horns-Club.com is liable for any damages, direct or indirect, that may in any way arise out of Horns-Club.com program. This includes, without limitation, damages arising out of travelling to and from events, meeting or communicating with other participants and the actions of other participants in programs sponsored by Horns-Club.com.

Disclaimer of warranty

Horns-Club.com provides service on an "as is" basis and grants no warranties of any kind, expressed, implied, statutory, in any communication with Horns-Club.com or its representatives, or otherwise with respect to the service. Horns-Club.com specifically disclaims any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Horns-Club.com does not warrant that your use of Horns-Club.com will be secure, uninterrupted, always available, or error-free, or will meet your requirements, or that any defects in the service will be corrected. Horns-Club.com disclaims liability for, and no warranty is made with respect to, connectivity and availability.

Limitation of liability: In no event will Horns-Club.com be liable to you for any incidental, consequential, or indirect damages (including, but not limited to, damages for loss of data, loss of programs, cost of procurement of substitute services or service interruptions) arising out of the use of or inability to use Horns-Club.com, even if Horns-Club.com or its agents or representatives know or have been advised of the possibility of such damages, or to any person other than you. Notwithstanding anything to the contrary contained herein, Horns-Club.com’s liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Horns-Club.com for the service during the term of membership.

Horns-Club.com does not screen the members registering for services offered by Horns-Club.com in any way. As a result Horns-Club.com will not be liable for any damages, direct, indirect, incidental and/or consequential, arising out of communicating and/or meeting with other members of this service, or introduced to you via this service. Horns-Club.com is not liable for the integrity of statements made by members as to their identity and general background. It is incumbent and advised upon the user to verify any and all information relating to but not limited to this subject. It is advised to check references of any user.

Nothing in this agreement shall exclude or limit our liability to the user for death or personal injury resulting from the negligence of Horns-Club.com or that of the employees or agents of Horns-Club.com or any liability which is due to our fraud or any other liability which we are not permitted to exclude or limit as a matter of law.

If any term is held to be invalid, unlawful or unenforceable, it shall not affect the enforceability of any of the remaining terms.
